Regulations on administrative offenses (administrative fine - planning and construction), 2018-2018

          בתוקף סמכותי לפי סעיפים 1 and 2 of the Administrative Offenses Law, 5556 1985 (hereinafter - the Administrative Offenses Law), with the consent of the Minister of Finance and the approval of the Interior and Environmental Protection Committee of the Knesset, I establish these regulations:

administrative offence

1.     Violation of a section of the sections of the Planning and Construction Law, 5575 1965 (hereinafter - the law), as specified in column A in the appendix, is an administrative offense.

Fixed administrative fine

-

(1)   regarding an individual - as stated next to it in column B in the supplement;

(2)   regarding a corporation - double the fine mentioned in paragraph (1).

          (ב) _cc781905- 5cde-3194-bb3b-136bad5cf58d_The fixed administrative fine for a continuing administrative offense listed in points 3 and 4 of the addendum shall be as stated in sub-regulation (a) with the addition of an amount as detailed next to it in column C, per day, up to 90 days; However, the amount of the fine detailed in column C will not be imposed, if more than 120 days have passed since the day a warning was given as stated in Section 8(b1) of the Administrative Offenses Law.

Offense in circumstances of residential use

3.     an offense has been committed as specified in items 3 and 4 in the appendix, in circumstances of residential use - the fine will be half the fine specified next to that offense in columns B and C in addition

Offense in the circumstances of work to erect a fence or use a fence

4.     an offense has been committed as detailed in items 2 and 4 in the appendix, in the circumstances of erecting a fence or using a fence, the height of which does not exceed 1.5 meters from the ground on both sides, it will be The fine is half the fine stated next to those details in columns B and C in the appendix.

5.     (a)   an offense has been committed as specified in details 1 to 4 of the regulation, the fine will not be imposed for the offense according to 2 ) unless a notice containing the details as stated in Section 8(b) of the Law on Administrative Offenses has been issued to the fined person, according to which if he does not correct the violation or return the situation to normal within 30 days, an administrative fine will be imposed on the fined person in accordance with these regulations; The notification will be drawn up according to a form ordered by the director of the national enforcement unit by virtue of his authority according to section 204 of the law, which will be published on the website of the national enforcement unit; For this matter, the "national enforcement unit" and the "director of the national enforcement unit" - as defined in section 203 of the law (hereinafter - the unit and the director of the unit, respectively).

          (ב) _cc781905- 5cde-3194-bb3b-136bad5cf58d_Despite what is stated in sub-regulation (a), if there have been previous administrative or judicial proceedings in the case of the fined person according to the law, the inspector may impose a fine on him as stated in sub-regulation (a) even without issuing the warning mentioned therein.

6.     The director of the unit shall report to the Interior and Environmental Protection Committee of the Knesset, once a year until the end of four years from the date of commencement of these regulations, regarding the administrative fines imposed pursuant to these regulations, according to the information in the unit's possession.
